Major Blockchain Players Demand SEC Provide Explicit Cryptocurrency Regulatory Guidance

A collective communication to the SEC requests more precise handling of digital assets, staking mechanisms, and secondary-market transactions as regulatory authorities evaluate proposed cryptocurrency regulations.

Half a dozen prominent blockchain organizations, featuring Chainlink Labs alongside the Cardano Foundation, have pressed the US Securities and Exchange Commission (SEC) to officially categorize digital commodities as distinct from securities, coinciding with the closure of the agency's public feedback period on proposed cryptocurrency regulations Tuesday.

Through a collaborative letter bearing an Oct. 20 date, Chainlink Labs, the Cardano Foundation, Hedera, Aptos Labs, Ava Labs and the Stellar Development Foundation requested that the SEC embed its digital commodity classification explicitly within the proposed Regulation Crypto Assets framework, contending that relying solely on interpretive guidance creates legal ambiguity for those operating in the market.

The organizations contended that while the SEC's current interpretation acknowledges digital commodities as a separate category, the proposed regulatory measures do not expressly incorporate that differentiation, which may result in developers and additional market participants remaining unsure about the applicability of specific securities regulations.

The correspondence additionally requests enhanced clarity regarding the application of securities laws to secondary-market transactions that involve digital assets, along with the regulatory treatment of staking and additional activities connected to decentralized blockchain networks.

The SEC's proposed cryptocurrency framework, unveiled in August, attracted approximately 140 public comments throughout a 60-day period, with industry stakeholders and legal experts presenting divergent perspectives on proposed exemptions for cryptocurrency offerings and a conditional safe harbor provision for specific tokens.
